Terms and Conditions for your Auto Transport Order:

1. The client/owner or owner's agent (referred to as "Shipper") agrees to hire All*Star Discount Auto Transporters, Inc. as a licensed, bonded and insured broker to commission a single contract carrier to transport the vehicle(s) described above from and to the stated locations. The Shipper certifies to be the legal owner of the vehicle(s) or to be authorized to act as the owner's agent for this transaction. All*Star Discount Auto Transporters will be referred to as "All*Star" and commission a third party: A licensed and insured motor transporter, referred to as "Carrier". Shipper acknowledges that any pick up or delivery date requested is an estimated time; that All*Star offers no guarantee of these dates. Carrier will transport the vehicle from pick-up to destination by a reasonable route, but will not be bound to any specific route or truck.

2. The Federal Highway Administration and The U.S. Department of Transportation require Carrier to be licensed and insured up to $750,000. In the unlikely event of damage to the vehicle, Shipper understands and agrees that any and all claims must be pursued directly with Carrier and Carrier's Insurance Firm. All*Star will not be held liable for any action of the Carrier. In order for Shipper to pursue a claim, Shipper must not any damage and sign the "Bill of Lading" (Receipt of Delivery) at pick up and delivery. The vehicle must be closely inspected and all damage must be noted at both locations and signed by Shipper and Carrier. Payment to Carrier without noting damage in writing will release Carrier from any liability. Damage resulting from towing services to vehicles that are non-operable cannot be covered by Carrier's insurance. In the event the vehicle must be held in storage, Shipper authorized the use of Shipper's insurance during this period. Shipper must pay in full any and all C.O.D. charges before filling a claim. All*Star will provide any and all necessary information to Shipper.

3. The Admin Fee listed per vehicle and charged by All*Star is fully earned upon Shipper signing or clicking this agreement and submitting payment by telephone, fax or internet/online. By submitting credit payment verbally by telephone or fax/internet shipper agrees to all terms and conditions. Once the order is dispatched, the entire contract is fully executed. In the event Shipper must change the order or cancel the order prior to the vehicle being assigned for dispatch, All*Star agrees to transfer the administrative deposit fee once to another order that can be placed within 90 days (shipper understands that C.O.D. charges are subject to change due to changes in location, vehicle, seasonal demand or other factors). Shipper fully understands that only the carrier determines transport fee. Shipper must pay remaining C.O.D. charges stated directly to Carrier upon delivery regardless of any claim. In some cases, which will be stated in agreement, payment must be made upon pick-up. In the event Shipper must change the order once a truck has been dispatched, a $150 dry-run fee must be paid to Carrier. Shipper understands and agrees the Admin Fee deposit is not refundable. Shipper understands and agrees that in addition to the admin fee deposit already charged, there will be and additional $75 fee charged to shippers credit card for any credit card chargeback of the administrative fee deposit.

4. All vehicles listed in this agreement are assumed to be operable unless otherwise stated on page one of this agreement and assigned a "non-op" fee of $150.00. In the event any vehicle assumed operable becomes non-operable for any reason between the time this contract is submitted and delivery of the vehicle, a $250.00 (payable C.O.D. to Carrier) will be assigned for each non-operable vehicle. All vehicle are assumed to be "stock", factory issued vehicles unless otherwise noted on page one. there is a minimum charge of $50.00 for over-sized vehicles, lifted vehicles and/or modified vehicles with special handling or space requirements. It is the responsibility of Shipper to properly state vehicle condition and style in this agreement and to guarantee that all vehicles are able to roll, brake and to steer even if non-operable. In the event vehicle must be stored or any other incidental costs are incurred, C.O.D payment must be made to Carrier before vehicle will be released.

5. Shipper agrees to be available personally, or to make available an agent for pick-up and delivery of vehicle. If Shipper cannot received delivery of the vehicle, Shipper agrees to pay any vehicle storage and additional transport and incidental fees by C.O.D. and to allow for delivery to be performed at the nearest suitable terminal. Shipper agrees to prepare the vehicle properly and to arrange for safe, suitable pick-up and drop-off locations. Preparation of the vehicle should include removal of any accessories that are unsecured or protruding (e.g. cargo containers, roof rakes, etc.) and to tun off any alarm systems. Selection of pick-up and delivery locations should ensure that no weight or height restrictions, narrow roads or cul-de-sacs, steep hills or low-hanging branches will inhibit the Carrier from safely performing their service. In the event the location is unsuitable for any reason, Shipper agrees to transport the vehicle to a suitable nearby location in mutual agreement with Carrier.

6. Shipper understands and agrees that this agreement is specifically for the transport of the vehicle described above; that any agreement to transport personal items in the vehicle must be made independently with Carrier, as Carriers are strictly regulated regarding the total weight of their loads. In the event personal items are stored in the vehicle, neither All-Star nor Carrier will be responsible or liable for such items and Shipper understands that C.O.D. charges for additional weight may be incurred.

7. This agreement is only existing contract between Shipper and All*Star and supersedes any previous written or verbal agreement. It can only be altered in writing by an officer of All*Star Discount Auto Transporters, Inc. This contract is agreed to be subject to the laws of Los Angeles County, California. Any dispute related to the performance of the breach of this agreement must be settled in this jurisdiction.
